Terms of Service

Welcome to Kathavani. Please read these Terms of Service ("Terms") carefully before using the Kathavani mobile application ("App") operated by Valtrium, LLC ("Company," "we," "us," or "our").

By downloading, accessing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

1. About Kathavani

Kathavani is a mobile application that provides audio stories from Hindu mythology and scriptures, designed for sleep, relaxation, and spiritual connection. The App is intended for entertainment and educational purposes only.

2. Eligibility

The App is available to users of all ages. By using the App, you represent that you have the legal capacity to enter into these Terms or, if you are a minor, that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

3. User Accounts

To access certain features of the App, you may be required to create an account. You agree to:

  • Provide accurate and complete information (including your name and email address)
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorized use of your account

You are responsible for all activity that occurs under your account.

Account Deletion

You may delete your account at any time through the App settings. Upon deletion, your personal data will be removed in accordance with our Privacy Policy. Backups may retain data for up to 90 days before being purged.

4. Subscriptions and Payments

Subscription Plans

Kathavani offers premium content through paid subscription plans. Pricing and plan details are displayed within the App and may change from time to time.

Billing

  • Subscriptions are billed in advance on a recurring basis (e.g., annually)
  • Payment is processed through Apple App Store or Google Play Store
  • Your subscription will automatically renew unless auto-renewal is turned off at least 24 hours before the end of the current billing period
  • You can manage your subscription and turn off auto-renewal in your App Store or Google Play account settings

Deleting the App or your Kathavani account does not cancel your subscription. You must cancel via your App Store or Google Play settings.

Refunds

All payments are processed by Apple or Google. Refund requests are subject to their respective refund policies. We do not directly process refunds. Please contact Apple Support or Google Play Support for refund inquiries.

5. Content

Ownership

All content in the App, including but not limited to audio stories, narration, images, graphics, and text ("Content"), is owned by Valtrium, LLC and is protected by copyright and other intellectual property laws.

Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Content for your personal, non-commercial use only.

Restrictions

You may not:

  • Download, copy, reproduce, distribute, or share the Content
  • Modify, adapt, or create derivative works from the Content
  • Use the Content for any commercial purpose
  • Remove any copyright or proprietary notices from the Content
  • Access the Content through any means other than the App

6. User Conduct

The App is for personal content consumption only. You agree not to:

  • Use the App for any unlawful purpose
  • Attempt to gain unauthorized access to the App or its systems
  • Interfere with or disrupt the App's functionality
  • Reverse engineer, decompile, or disassemble the App
  • Use any automated means to access or collect data from the App

7. Disclaimers

Not Medical Advice

The App is intended for relaxation and entertainment purposes only. The Content is not a substitute for professional medical advice, diagnosis, or treatment for sleep disorders or any other health conditions. Always seek the advice of a qualified healthcare provider with any questions you may have regarding a medical condition.

Content Accuracy

While we strive to ensure the accuracy of our stories and their faithfulness to Hindu scriptures and mythology, the Content is provided for educational and entertainment purposes only and should not be considered religious instruction or authoritative spiritual guidance.

We make every effort to verify the accuracy of our Content. However, errors may occasionally occur. If you notice any inaccuracies or errors in our Content, please contact us at contact@kathavani.com so we can review and correct them.

"As Is" Basis

The App and Content are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

8. Limitation of Liability

To the fullest extent permitted by applicable law, Valtrium, LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:

  • Your use or inability to use the App
  • Any unauthorized access to or use of our servers and/or any personal information stored therein
  • Any interruption or cessation of transmission to or from the App
  • Any bugs, viruses, or other harmful code that may be transmitted to or through the App

Our aggregate liability is capped at the greater of US$50 or the amounts you paid to us in the preceding 12 months.

9. Termination

By You

You may stop using the App at any time. You may also delete your account through the App settings.

By Us

We reserve the right to suspend or terminate your access to the App at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason.

If your account is terminated for violation of these Terms, you will not be entitled to any refund of subscription fees.

10. Changes to Terms

We may update these Terms from time to time. If we make material changes, we will notify you through the App or by other means. Your continued use of the App after such changes constitutes your acceptance of the new Terms.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

Any disputes arising from or relating to these Terms or the App shall be resolved exclusively in the state or federal courts located in Delaware.

13. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.

14. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Valtrium, LLC regarding the use of the App and supersede any prior agreements.

By using Kathavani, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service.
